Who you are dealing with
Kaive is operated by ElCapStudios, a business established in Ireland. These terms are a contract between you and us. Using the app means you accept them.
This is not medical advice
This is the most important thing on this page, so it comes first rather than buried in clause 14.
Kaive is a fitness and nutrition tracker. It is not a medical device, and nothing in it is medical advice, diagnosis or treatment. Its calorie targets, training loads, recovery scores and coaching suggestions are calculated from general formulae and from what you have told it. It does not know your medical history.
Talk to a doctor before starting a new training or eating plan, particularly if you are pregnant, have a heart condition, diabetes, an eating disorder or a history of one, an injury, or you are taking medication that affects your heart rate or appetite.
The heart rate, sleep and recovery figures shown come from consumer wearables. They are estimates. Do not use them to make a medical decision. If you feel unwell during exercise, stop, whatever the app says.
If you are struggling with food or with your body, the calorie and weight tracking in this app may do you more harm than good. In Ireland, Bodywhys offer support at bodywhys.ie. Please talk to somebody.
Your account
- You need to be at least 16 to use Kaive.
- Give us an email address that works — it is how you recover your account.
- Your account is yours. Do not share it.
- Tell us at security@kaive.app if you think somebody else has got into it.
- You can delete your account at any time, from Settings. It is immediate.
Membership
The free tier and the trial
Everyone starts with 14 days of the paid features, and we do not ask for a card to do it. When the trial ends you drop to the free tier automatically. Nothing is charged and nothing is deleted.
The free tier keeps logging, device syncing and your full history. The paid tier adds AI coaching, session analysis, advanced analytics, training plans and meal planning.
Paying
- Subscriptions are billed in advance, monthly or annually, through Stripe.
- Prices include VAT where it applies to you.
- Subscriptions renew automatically until you cancel.
- If a price changes we will tell you at least 30 days before it affects you, and you can cancel before it does.
Cancelling
Cancel any time from Settings, in about the same number of taps it took to subscribe. That is deliberate: cancelling should not be harder than starting.
When you cancel you keep everything until the end of the period you have already paid for. We do not cut you off the moment you cancel, and we do not refund part months.
Your 14-day right to change your mind
As a consumer in the EU you have 14 days to withdraw from a contract for digital services, and get a full refund.
The free trial does not use up any of that. The 14 days runs from the day you actually subscribe and pay, not from the day you signed up. The trial takes no card and charges nothing — when it ends you simply drop to the free tier — so there is no contract for a paid service until you choose to start one.
If you subscribe part-way through your trial, the 14 days runs from that day. And if you never subscribe at all, none of this applies to you.
There is a catch the law requires us to be honest about: if you ask us to start the service immediately, and you acknowledge that doing so means you lose the right to withdraw once it has been fully performed, then that right can be lost. In practice, for a subscription you can cancel at any time anyway, so:
If you subscribe and change your mind within 14 days, email support@kaive.app and we will refund you. We would rather do that than argue about it.
Access codes
Codes granting free or discounted access have no cash value, cannot be exchanged for money, and may be withdrawn if they are shared publicly or used in a way they were obviously not meant for.
What you may not do
- Break the law with it.
- Try to get at other people's data, or at parts of the service that are not yours.
- Scrape it, resell it, or run it as the back end of something else. The AI features cost us money per request and are for personal use.
- Upload anything you do not have the right to upload.
- Deliberately try to break it. Reporting a flaw is welcome; exploiting one is not.
We may suspend an account that does these things. Where it is reasonable to do so, we will tell you why first.
Your data belongs to you
You keep ownership of everything you put into Kaive. You grant us only the permission needed to run the service for you — to store it, show it back to you, and process it for the features you use.
We do not sell it and we do not use it for advertising. The Privacy Policy sets out the detail.
You can export everything at any time, and you should occasionally. It is your history.
What we promise, and what we do not
We will try to keep Kaive running and working. We cannot promise it will never be down, never lose data, or never be wrong. It depends on services we do not control, and on wearables whose measurements we cannot verify.
So the service is provided as it is. To the extent the law allows, we are not liable for indirect losses, or for anything arising from you relying on a number in this app in place of professional advice.
Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are unaffected by anything on this page.
Where we are liable, that liability is capped at what you have paid us in the 12 months before the claim.
Ending it
You can stop at any time by deleting your account. We may end or suspend your access if you seriously or repeatedly breach these terms, or if we stop offering the service — in which case we will give reasonable notice and time to export your data.
Changes to these terms
We may update these terms. If a change materially affects you, we will tell you in the app at least 30 days beforehand, and continuing to use Kaive after that means you accept them. If you do not, cancel and we will refund the unused part of your subscription.
Law and disputes
These terms are governed by Irish law, and the Irish courts have jurisdiction. If you are a consumer resident elsewhere in the EU, you keep the protection of your own country's mandatory consumer law and may bring proceedings there.
